Portrait Agreement

Agreement Overview: This agreement expresses the full and complete agreement between the CLIENTS (Hereafter referred to as CLIENTS) and Valerie PRUDON Photography (Hereafter refereed to as Valerie PRUDON Photography) regarding the subject matter hereof. It supersedes all prior agreements. The only way to add or change this agreement is to do so in writing, signed by all parties.

Cooperation: Unless otherwise noted, Valerie PRUDON Photography, it's associates or employees will be the exclusive photographer(s) at this portrait photography shoot. The CLIENTS agree that good faith cooperation and communication between them is important in obtaining a good result. CLIENTS must also notify Valerie PRUDON Photography and photographer(s) in writing if they wish to have anything photographed in a particular way. Valerie PRUDON Photography or the photographer(s) will not be held accountable for not photographing desired portraits, if there is no one to assist in identifying these particular details and photographs on the day. Valerie PRUDON Photography is not responsible if key individuals fail to appear or cooperate during photography, or for missed images due to details not revealed to Valerie PRUDON Photography or beyond the photographer(s) control.

Session Fee: The session fee pays for the time and talent of the photographer and for your inperson viewing appointment. It does not include any finished portraits. The ‘Session Booking Fee’ must be paid prior to the session, & within 3 days of the invoice date, to secure the requested appointment time. Your session is only CONFIRMED when this is paid in full. If the ‘Session Booking Fee’ is not paid within 3 days of the invoice then the appointment time being held for you will be released & made available to other clients. Session fees are non-refundable, however with 48 hours notice it can be rescheduled in case of an emergency.

House rules: CLIENTS agree and understand that the photographer(s) are limited by the guidelines of the location site/venue management/government rules and CLIENTS agree to accept the results that may occur from said guidelines. Negotiation with the officials/management for moderation of guidelines is solely the CLIENTS responsibility. If CLIENT appears under the influence of alcohol or drugs during the shoot, Valerie PRUDON Photography has the right to cancel the shoot immediately due to liability and health concerns arising.

Images and Copyrights: Photographs/images produced by Valerie PRUDON Photography are protected by Copyright Law (all rights reserved). Upon final payment by CLIENTS, CLIENTS are allowed to display resulting images for personal use. Said images may not be altered or reproduced in any manner without prior written permission of Valerie PRUDON Photography. CLIENTS will receive a high resolution digital disk/USB with printing rights. When publishing the photos socially or commercially, Valerie PRUDON Photography must be noted as the photographer. The CLIENTS must obtain written permission from Valerie PRUDON Photography prior to the CLIENTS, their associates, friends or relatives selling the photographs.

Valerie PRUDON Photography does not provide any unedited images to CLIENTS as it does not represent the quality Valerie PRUDON Photography strives for. Valerie PRUDON Photography takes pride in the edited images, and images will not be delivered if they do not meet Valerie PRUDON Photography’s quality standards. Valerie PRUDON Photography’s edited images include colour correction, colour enhancements, exposure correction, shadow and highlight recovery, lens correction, and Valerie artistic touch.

Liability: Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.

Completion Schedule: Images are expected to be edited within 2-3 weeks after the photo shoot date. CD/DVD/USB delivery is expected within this time frame, but may take longer. Prints and extras will be available anywhere from 2-6 weeks, after they are ordered. These items can be picked up from Valerie PRUDON Photography's home studio by appointment only (please email Valerie PRUDON Photography and ask for current address). Collection must occur within 3 months from the delivery date or Valerie holds the right to dispose of the artworks.

Re-shoot: Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the photographer.

Archive: Four weeks after the photoshoot, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Valerie will archive the ordered images for 3 months after the Reveal session. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.

Damage: Photographer is not responsible for the damage of portraits after delivery to client. Client assumes all responsibility for the safety of all portraits upon receipt.

Viewing Session: While Valerie does capture many images during your session, you will see only those images selected by her, the artist, for previewing. She carefully renders each image to ensure maximum artistry and technical perfection. Images with eyes closed, heads turned, duplicates, etc. will not be shown and are removed from my archives permanently after the artist rendering is complete.

Digital Files: Once the digital files are submited to the client either by CD, USB, electronic transfer or email, the order is deemed nonrefundable.

Selfies: The CLIENT is not allowed to take any photo with her own phone or camera during the Photo session.

Model Release

I hereby give to Valerie PRUDON Photography the absolute and irrevocable right and permission with respect to the photographs that she has taken of myself and/or my minor child in which she may be included with others:

a/ To copyright the same in the photographer's name or any other name that she may select;

b/ To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and;

I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
